The contract When a holiday booking is made and Collineige Ltd has received the appropriate deposit, a contract exists between the Party Leader and Collineige on the following conditions. A deposit of 35% of the holiday cost is payable immediately with the insurance premium (if taken). Collineige will issue a Confirmation Invoice. This must be checked carefully to ensure all details are as requested. Telephone and website options do not give rise to contractual obligation and may be cancelled by Collineige or the client. Once the Contract is made we are responsible to you to provide the holiday you have booked and you are responsible to us to pay for it.
In parties of two or more people, the person who makes the booking by signing the Booking Form or otherwise contracting with Collineige accepts responsibility for making all payments to Collineige for all members of the party. If the client is under 18 (on the date of departure) and the client's parents or guardian are not travelling with the client, they must write to Collineige with their written consent.
Please note: It is important to check carefully the written confirmation of your booking when you receive it, or if booking late that all the details are exactly as you requested. Our responsibility is to provide you with the holiday you have booked and as confirmed to you. If you want to cancel or change your booking later, you may have to pay amendment or cancellation costs (described below) which may be as much as the whole holiday cost.
Unless otherwise stated, the liability of all persons listed on the Booking Form is joint and several. The Contract is governed by English law with any action under this Contract being heard within the jurisdiction of English courts.
Payment Collineige must receive full payment for the holiday at least 8 weeks before the start date of the holiday. If Collineige does not receive this full payment we reserve the right to regard the holiday as cancelled and levy the appropriate cancellation charges. All payments made by you are not refundable, except as detailed below. Subletting of any part of the holiday to persons other than those named on the booking form is prohibited and may be illegal. For bookings made within 8 weeks of departure the full cost of the holiday and insurance premium is payable immediately. If a client starts his/her holiday without Collineige having received full payment he/she must settle in full immediately on arrival in the resort in cash or have his/her holiday terminated immediately.
Please note that balance payments made by Visa and Mastercard will be subject to a 2% charge.
Cancellation If a booking is cancelled you must inform Collineige in writing immediately and the following charges will come into operation once the cancellation is received in writing. Special delivery is strongly recommended. |
Alterations Collineige will not normally materially modify or cancel any holiday within 8 weeks of departure, except in circumstances outside Collineige's control, such as, but not limited to, war (or threat of war), riot, civil strife, industrial dispute, terrorist activities (threatened or actual), natural and nuclear disaster, fire or adverse weather conditions, technical problems with transport or aircraft grounding, or other circumstances amounting to force majeure.
Occasionally circumstances arise where we have to alter your holiday. If the circumstances are within our control and the alteration were to be a change of airport, resort or accommodation we will offer a holiday of a similar standard if possible. If the alternative is of a lower standard then the client may choose a full refund less reasonable costs. We do reserve the right to make minor alterations, which do not materially affect your holiday, without prior notice. Any refunds are strictly limited to monies paid to us by the client(s) in respect of the holiday booked and no liability can be accepted for further expenses incurred by the client(s).
Descriptions All flight, chalet, hotel and apartment descriptions are given in good faith, however Collineige cannot accept responsibility for the operation of these facilities, all of which are beyond our control. In the same way Collineige cannot be held responsible for any loss, cost or delay due to the occurrence or danger of floods, avalanche, earthquakes, war, strikes, civil strife, technical problems to transport, closure of airports or any similar events beyond our control.
Holiday costs All prices quoted are based upon costs and exchange rates current at the time. Prices may be subject to surcharges in cases such as, but not limited to, governmental action, exchange rate fluctuations and increases in air fares, fuel prices, aircraft surcharges or ground operator's charges.
Transport Arrangements for transport (including car hire) are made with independent companies and are subject to the conditions of the operators or owners of such transport for whom we act as agents. Flights forming part of the holiday are subject to conditions on the ticket issued by, or on behalf of, the carrying airline. Collineige cannot accept responsibility for any loss, cost, or delay due to the performance of these modes of transport. All clients travelling in Collineige vehicles do so at their own risk, the client having satisfied himself as to the safety of the vehicle and the competence of the driver. The client is responsible for checking-in at the correct time. Collineige accepts no responsibility for the client missing flights as the result of late check-ins.
Passport and visas Any passports, visas and health certificates or other travel documentation required for the holiday must be obtained by the client, whose responsibility it remains to ensure that these are in order, and to meet any additional costs incurred (whether by the client or by Collineige on the client's behalf) as a result of failure to comply with such requirements. Clients who elect to travel without a necessary visa do so at their own risk and Collineige is powerless to assist if the various Customs and Immigration officers refuse entry into any country involved in your holiday. Necessary visas must be arranged before the final balance is paid eight weeks before departure, if not Collineige cannot refund any monies paid because of inability to travel due to a lack of visas.
Responsibility of the client If the action of clients cause damage to the accommodation in which clients are staying or cause delay or diversion to any flight or other means of transportation, the client is liable for all repair, restoration and compensation costs and clients agree to fully indemnify Collineige against any claim (including legal costs) made against Collineige by or on behalf of the owners of such accommodation or operator of such flight or other means of transportation. Collineige reserves the right to terminate the holiday of clients who, in the opinion of any airline pilot, chalet owner, Collineige Director or Representative, have acted in such a manner as to cause damage, discomfort, distress or danger to their fellow holidaymakers. No credit or refund is possible for any unused services included in the basic holiday price, or for any loss, mislaid or destroyed travel documents. If a client neglects to take out appropriate insurance he/she may find himself/herself in the position of not being covered for any necessary rescue, treatment, or assistance etc. Collineige cannot be held responsible for any problems or losses that may result.
Changes by you If it becomes necessary for you to change the details on the booking form once it has been received by Collineige then we will charge £60 for each person changed to cover administration costs plus all expenses incurred in making the changes, payable whether or not we are successful in making the changes. Changes made within 8 weeks of departure may be treated as cancellations and re-bookings. All changes must be requested in writing.
Problems and complaints Any problems in the resort should be referred to the most senior member of the Collineige staff in the resort who will do his/her best to resolve the particular problem. In the case of this being insufficient any complaints should be sent to Collineige within 28 days of the end of the holiday.
Limitation of liability Collineige cannot be held liable or accept responsibility for death, bodily injury or illness caused to the signatories of the Booking Form. This does not exclude Collineige's liability for any negligent acts or omission of Collineige's employees, agents, suppliers or sub/contractors or air/sea carriers who are limited by international convention. All bookings are subject to the conditions of carriage of the carrier used. Collineige's liability in any action (excluding that for personal injury, illness or death) is limited to twice the value of the invoiced holiday cost. In respect of any legal fees incurred abroad, the client must make an insurance claim under the legal expenses section of client's insurance cover.
Any excursions or activity in which the client partakes locally, such as, tobogganing, inner-tubing, snow-mobiling, mountain biking, canyoning, climbing, etc remain at client's own discretion and liability. Personal property remains the responsibility of the owner. |
